Consumer protection guarantee for shoes. What is the guarantee for shoes?

Antipyretics for children are prescribed by a pediatrician. But there are emergency situations for fever when the child needs to be given medicine immediately. Then the parents take responsibility and use antipyretic drugs. What is allowed to give to infants? How can you bring down the temperature in older children? What medicines are the safest?

According to the Law “On the Protection of Consumer Rights”, there is no clear warranty period for such a wardrobe item as shoes. Is there a fixed warranty period for shoes under the Law? In what cases can I return shoes (sneakers or shoes) back to the store? Read the article.

According to article 19, the buyer can apply to the store with claims about the quality of the purchased pair of shoes, whether it be shoes or a regular pair of sneakers, within 2 years from the date of purchase. This is the statutory warranty period.

However, if at the time of sale the seller announced a different warranty period for the purchased pair of shoes, then you will no longer be able to use the legal warranty period.

The day of purchase is calculated as follows: the countdown does not start from the day of purchase, but only from the next. So, for example, if you bought sneakers on September 3rd, then the countdown of two warranty years will begin on September 4th.

Read about other nuances of the warranty period for shoes in the next section.

Who else can set the warranty period for shoes?

In addition to that established by the Law "On Protection of Consumer Rights", do not forget about the warranty period, which can be set by each manufacturer independently. As a consequence, it is from this warranty period that the buyer will have to build on.

Can the store independently set the warranty period for shoes? No, however, the sellers of shoe outlets often engage in arbitrariness, setting minimum warranty periods of 1-3 months.

To find out the real warranty period for the purchased pair of shoes, it is better to get in touch with the representatives of the manufacturer.

How does the guarantee work?

Information

It is important to bear in mind that the guarantee for footwear does not begin to operate from the moment of purchase, but from the start of the season for which it is intended.

So, if you bought winter boots in September, the 30-day warranty period set for them will only take effect on December 1 of the current year. If you wear boots before the start of winter and they become unusable, the seller will have the right to refuse to hand them over for warranty repairs, since in this case there will be a seasonal violation of operation, and not a factory defect.

What is the mechanism of the warranty period for out-of-season shoes (sports, office, home)? For shoes that are usually worn indoors, the warranty period begins to operate from the date of purchase.

What can determine the length of the warranty period?

The warranty period for shoes may depend on the material from which they are made. So, according to the law:

  • For shoes made of leather, the warranty period should not be less than fifty days;
  • Shoes made with leather-like rubber are covered by a seventy-day warranty period;
  • Shoes made on rubber (porous in composition) are covered by an eighty-day warranty period;
  • Shoes with plastic soles are also covered by an eighty-day warranty period;

What can the buyer expect under the warranty period?

Within the framework of the warranty period, it is possible if, during the wearing process, it was discovered that it is defective / has some kind of defect (leaks, cracks, fittings fall off, etc.). In this case, the buyer has the right to rely on:

  • Exchange of a low-quality pair of shoes for a similar one;
  • Exchange of low-quality shoes for a pair of shoes of a different brand (and value) with recalculation of the purchase price;
  • Reducing the cost of a pair of shoes due to identified defective items;
  • Warranty repair (read further in the article);
  • Payment of a certain amount of money for self-repair of shoes;
  • Refund of the full cost of shoes in exchange for its return;

The buyer has the right to independently choose the requirements for the return of low-quality shoes. The seller has no right to challenge the customer's decision.

If the seller refuses to satisfy one of the stated requirements, the buyer must leave a written claim addressed to the manager. If within 10 days there is no response from the store, the buyer must contact the consumer protection service or file a claim by going to court.

Warranty return process

In case you find some kind of marriage in the purchased pair of shoes and decide to return the shoes, you will need:

  • The shoes themselves;
  • Warranty card;
  • The passport;
  • cashier's check;

If the cash receipt is lost, this cannot be a reason for the seller to refuse to repair / exchange / refund money for the returned pair of shoes (reference to Articles 18 and 25 of the Consumer Rights Protection Law). An alternative to a check can be a witness who confirms that the purchase was actually made in a particular store.

The store must indicate the reason for the return of the shoes, as well as specific requirements. Further:

  • The seller will offer to fill out an application for the return of shoes;
  • If you want to replace a pair with a similar one / a pair of a different brand / return the money, the seller will take the shoes for examination to determine the cause of the marriage;
  • If you would like to return your shoes for warranty repair, you will need to complete another application;
  • After filling out the application and transferring the shoes to the seller, they are sent for examination, the results of which, according to the Law, you must find out within 10 days;

The seller will help you complete the application.

The term of the warranty repair is set by each store independently.

Warranty periods for sneakers and shoes

Shoes and sneakers are demi-season shoes, the warranty period for which starts from the date of purchase and continues until the period stated in the warranty card expires.

Each manufacturer of sports shoes and shoes has an individual warranty period.

Information

If at the time of purchase the seller did not inform you orally or in writing about the warranty period for the purchased pair of sneakers or shoes, the warranty period is automatically extended by two years.

Warranty period for winter shoes

Today in shops, markets, boutiques you can find a huge number of shoes for every taste and color. Unfortunately, not all manufacturers can boast of the excellent quality of their products. The guarantee of the quality of this type of product cannot be an impeccable appearance or a rather high price. This can only be evidenced by the warranty period. There are different warranty periods for shoes, depending on the type and season. Winter shoes have their own characteristics, as they are more expensive.

Responsibility for buying winter shoes

Winter footwear includes the following types: après, boots, over the knee boots, cloaks, felt boots, ugg boots, high fur boots, “moon” boots, boots, half boots, climbing boots, winter sneakers, puffy boots and many others.

The warranty period for winter shoes is valid thirty days from the date of the onset of the winter season. For example, if a customer purchased...

Warranty for children's shoes

Despite the fact that children's shoes are subject to more serious requirements in production than to adults, nevertheless, some shortcomings may appear in the process of wearing. In some cases, these can be quite serious flaws (for example, peeling off the sole), as a result of which it becomes impossible for a child to wear such shoes. Moreover, very often the cost of a purchased pair or the popularity of the brand of children's shoes does not affect the percentage of marriage. Much here depends on the integrity of the manufacturer.

The best protection against low-quality products is the manufacturer's warranty obligations, when it becomes unprofitable for him to produce a deliberately "defective" product. “But what about the certificate or declaration of conformity?” - you say. Certification is a necessary process, in particular with regard to products for children. However, the presence of a certificate or declaration of conformity does not give you a 100% guarantee that the purchased pair ...

Hello Tatiana.

The warranty period of wearing is considered from the day of sale through a retail network or the beginning of the season, in case of purchase of goods in the off-season, each region determines the start and end of the season, depending on the specific climatic conditions. In Moscow, for example, the seasons change each other as follows:

Existing legislation does not regulate the duration of the warranty period, but instead obliges the seller to notify the buyer about it - by a mark on the check or by a clearly visible announcement on the trading floor. For example, in Yekaterinburg and the Sverdlovsk region, the terms are specified in the "Rules of Trade" No. 55. In order to obtain a patent for the right to trade in the district trade department, the entrepreneur must buy these rules, read and hang them next to the "Consumer Protection Law". Otherwise...

You can cancel your order for any reason and return the goods of proper quality (shoes are not worn, have a marketable condition) within 14 calendar days from the date of payment, not counting the day of purchase.

The moment of payment is considered:

Payment of cash on delivery in the delivery service; cash payment to the courier; crediting funds by bank transfer using the Liqpay system.

Return of goods is at the expense of the customer. To do this, it is enough to indicate the cash on delivery (the cost of the goods according to the check) when sending the return to the Novaya Pochta branch in Dnepropetrovsk.

In the event that you refuse the parcel at the Nova Poshta office / upon delivery by the courier of the Most Express company without paying the cost of the order (received-refused), you must pay the cost of returning the goods.

Hello Oksana!

According to the Consumer Rights Protection Law, a product such as shoes is seasonal, that is, the warranty period does not begin from the moment of purchase, but from the moment the season for these shoes begins. For example, a guarantee for winter shoes purchased in the summer begins to operate with the onset of winter time.
You should also be aware that according to the Consumer Protection Law, the one-month warranty period set by shoe sellers is nominal. In other words, if after one month from the date of purchase, but within two years, your shoes are out of order for no reason, then you can go to the store and demand a replacement!

I bought winter boots in Chester stores at the end of January-beginning of February of this year. Genuine leather and fur. The rest of the winter went well. And when I put them on this year, a week later there was a hole of a couple of cm at the sole. Of course, in the summer I didn’t wear winter boots, and they were cleaned and well-groomed in a box.

Here is what they told me in Chester: "Shoes are guaranteed for 30 days, during which you can contact our claims department with any problem. We also, if possible, try to resolve such issues after the warranty expires. But in this In this case, unfortunately, a sufficiently long period has passed, during which the couple could be exposed to various external influences, which complicates the establishment of the cause of the problem.

You can apply to an independent examination. If it determines that a manufacturing defect was the cause of the problem, you will be issued an appropriate opinion, with which you will need to ...

All kinds of shoes

Hello! Tell me what to do in this situation: in November I bought autumn boots, the warranty ended, I threw out the check, and at the moment I found that a hole had formed in the left boot (cm 4) between the sole and the base of the boot. What to do in this situation? Is it possible to prove. is this a factory marriage? There is no receipt, but there was a box with a label from this store. Thanks.

In this situation, it is necessary to conduct an examination to determine the cause of the deficiency.

Sincerely yours, E.S. Bulaikin, Legal Counsel of SROO OZPPSO

Hello! On November 15, 2007, I bought winter boots from TERVOLINA. 30-day warranty. The sellers assured of the high quality of the goods - boots cost almost 6 thousand rubles. On January 17, the boots were torn along the seam along the sole. Judging by your answers, it is clear to me that until I prove that the defects of the goods arose before it was transferred to the consumer, the case cannot be won. But this is absurd! It turns out that the boots should be torn before...

Returning low-quality shoes is much more difficult than, for example, expensive household appliances. The guarantee for shoes does not last long, moreover, this is a seasonal product, so the warranty period here is counted in a special way.

In accordance with paragraph 2 of article 19 of the Law for seasonal goods, the warranty period is calculated from the moment the corresponding season begins. The start of the season is determined by the subjects of the Russian Federation, respectively, based on local climatic conditions. For example, in Moscow, for winter goods, this period is from November 1 to March 1; for goods of spring and autumn assortment - from March 1 to May 1 and from September 1 to November 15; for summer goods - from May 1 to September 1.

Consider the most typical problems that buyers face when buying low-quality shoes.

A reminder to the consumer about the warranty period for shoes

The real facts of the present indicate that shoe sellers very often falsely inform consumers about what the upper of the shoe is made of: natural leather and textiles or synthetic and artificial leathers. This is a matter of principle. The warranty period depends on the composition of the upper material. Unscrupulous sellers go to various tricks, and sometimes they directly mislead in order to avoid liability for warranty obligations. The information offered for review will provide the consumer with the opportunity to be as knowledgeable as possible on this issue.

The consumer, according to Art. 15 of the Law of Ukraine "On Protection of Consumer Rights", has the right to receive the necessary, accessible, reliable and timely information about products, providing the possibility of its conscious and competent choice. Shoe Warrantyprovided for by the law of the Russian Federation dated February 7, 1992 No. 2300-1 "On consumer protection". In accordance with the law, in case of detection of defects in the purchased goods, the consumer has the right to file an appropriate claim. What is the warranty period for shoes and how to calculate it correctly, you will learn from our article.

Warranty period for shoes

The legislator has established a rule according to which the consumer can make a claim to the seller regarding the defects of the purchased goods during the entire warranty period.

There are 2 warranty periods for shoes:

  • set by the manufacturer of the product;
  • set by the seller of the goods.

The first term is mandatory, and the second is set at the discretion of the seller.

The seller, as a rule, establishes a guarantee for shoes from 14 to 30 days.

Mandatory warranty periods established by the legislator and observed by the manufacturer are calculated in accordance with a specific GOST:

  • GOST 26167:2009 "Casual footwear made of synthetic and artificial leather" - warranty period from 30 to 80 days;
  • GOST 2063-92 "Sports shoes" - 60 days;
  • GOST 19116 "Model footwear" - from 60 to 90 days;
  • GOST 26165: 2009 "Children's shoes" - 30 days;
  • GOST 1135-88 "Home and road shoes" - 30-35 days.

If the shoes were purchased at a seasonal sale, the warranty period also applies to them. At the same time, the guarantee does not begin to flow from the moment of purchase, but from the day when the season for wearing shoes comes.

The guarantee for shoes begins to be calculated with the onset of the corresponding season. The timing of the onset of the season is determined in each region based on the characteristics of the climate.

If we consider, for example, the climatic conditions of the European part of Russia, in particular Moscow and the Moscow region, then the seasons are determined by the following calendar periods:

  • winter - from November 1 to March 1;
  • spring - from March 1 to May 1;
  • summer - from May 1 to September 1;
  • autumn - from September 1 to November 15.

That is, if, for example, you are a resident of Moscow and bought winter shoes in the summer, it is quite logical that you will wear them no earlier than November. Therefore, the warranty period begins to flow from November. However, if you started wearing shoes out of season, quality claims will not be accepted.

Don't know your rights?

As a rule, along with the shoes you are given a memo in which there is an indication of the warranty period. In some cases, such information can be seen on the information board in the store. In some regions, rules for trade in certain types of goods are issued, which provide for the seasons of the seasons.

If you ordered shoes online or from a catalog, then in this case the moment of concluding the contract and depositing money may not coincide with the moment of transferring the shoes to the consumer. So when does the warranty period start? From the moment the shoes are handed over to the buyer.

What is covered by the footwear warranty?

As you know, shoes consist of the main part and accessories, which include various fasteners, buckles, decorations and heels. But very often, sellers assure buyers that the warranty does not apply to fittings. Is it so? No.

The footwear warranty also applies to accessories. As a general rule, if a separate warranty period for fittings is not established, then it is equated to the warranty period for the main product.

However, it is possible to make a claim after the expiration of the warranty period, both for shoes and accessories. The legislator clearly defines that in this case the consumer has the right to file a claim if the defects of the purchased goods were discovered within a reasonable time, but no later than 2 years from the date of purchase. That is, if you prove that defects in the product arose before the moment of purchase (for example, there was a hidden factory defect that “revealed” itself in rainy weather), then the seller has no right to refuse to satisfy your claim.

In most cases, this requires an appropriate examination. However, we recommend that you first write a claim to the seller, as he can satisfy it voluntarily. And only then, if the seller does not satisfy the claim, go to court and give the shoes for examination.

Winter footwear warranty

Despite the fact that winter shoes are one of the simplest in terms of their “maintenance and configuration”, in practice there are quite a few questions related to the guarantee for winter shoes.

A fairly common problem is that very often winter shoes are slippery, and it becomes impossible to walk in them. But is this case included in the guarantee for shoes in winter?

The first thing you need to do is send a claim to the seller (See below). How to return an item of inadequate quality?). If he refuses to voluntarily change shoes, then you have the right to go to court and conduct an examination. But we warn you right away - in this case, you will need to prove that the shoes are made in violation of GOST and TU, production technology, etc. In addition, there is Article 1064 of the Civil Code, which clearly states that the seller is exempt from compensation for harm in that if he proves that the damage was caused through no fault of his own. That is, we recommend that you involve the shoe manufacturer as a third party.

In addition, some shoes are worn only at certain temperatures and weather conditions due to the fragility of the material. The seller must notify you of this. This is his duty, provided for in Article 10 of the Law "On Protection of Consumer Rights". If he did not, and your shoes were damaged as a result, you can safely file a claim.

Don't be afraid to defend your rights. If the seller voluntarily refuses to satisfy your claim related to low-quality shoes, and you are firmly convinced that the guarantee for the shoes is valid, go to court. No state duty is paid in consumer protection cases. In addition, if during the trial an examination was carried out, the results of which reveal that the seller is to blame for the shortcomings of the goods, he will pay for the services of an expert, regardless of who initiated the examination.

Many buyers, faced with unscrupulous sellers, do not know how to return unsuitable or defective shoes to the store.

How to behave in a conflict situation and what to do?

Dear readers! Our articles talk about typical ways to resolve legal issues, but each case is unique.

If you want to know how to solve exactly your problem - contact the online consultant form on the right or call free consultation:

In order to feel confident in such cases, you need to know what rights the buyer can exercise during the warranty period and after its expiration.

Warranty period for shoes according to the law

Shoes must comply with specific GOSTs, which stipulate mandatory warranty periods. This rule applies to all types of shoes.

For different types of shoes, these terms are different, but for any kind of shoes, they cannot be shorter than 30 days.

The manufacturer cannot establish a warranty period shorter than the period prescribed by GOST.

The seller can set his own warranty period, but by law, the seller's warranty cannot be less than the manufacturer's warranty.

If the seller sets a warranty period shorter than the manufacturer's warranty period, and, for example, offers you after this period, send your claims to the shoe manufacturer, know that he is acting illegally.

From what date is the guarantee for winter, other seasonal shoes valid?

If you bought shoes during the season of operation, then the warranty period starts from the moment of purchase.

If you bought seasonal shoes in advance, before the start of the season, then the warranty period is calculated from the start date of the season of the corresponding shoe.

When does the winter season start for shoes? Each locality has its own date. The easiest way to find out is by calling the local Rospotrebnadzor.

In Moscow, for shoes, the summer season begins on May 1, the autumn season starts on September 1, the winter season starts on November 1, and the spring season starts on March 1.

Return within 14 days of purchase

It may happen that the purchased for some reason the shoes did not fit you, for example, you are simply not satisfied with the size or color, you can exchange it within 14 days.

If that doesn't help, Contact the Consumer Protection Society. They will advise you, provide legal support and help you develop a plan for further action.

Do not be afraid file a lawsuit.

If the warranty period has not expired, then the examination of shoes is always carried out at the expense of the seller and you will not have to pay for it.

When will the shoes not be accepted into the store?

There are, which, by the way, includes shoes. Therefore, by law, there are only a few situations in which you can't return the shoes:

  1. If the shoes are not defective, but as a result of wearing lost its merchandise;
  2. If shoes have mechanical damage caused by the fault of the buyer (cuts, burns, etc.);
  3. If the buyer repaired shoes before returning it to the seller;
  4. If the shoes have defects resulting from improper use.

In all other cases, the law is on your side. Stand up for your rights and get back.

By purchasing shoes, we expect that it will serve us for more than one season. However, in practice, a thing can deteriorate much earlier, even a few days after purchase.

What to do in this case: go to the workshop or take the goods back to the store? The procedure depends on whether the shoes have a warranty or not.

What is the warranty period for shoes provided by the legislation of the Russian Federation?

Shoes are an essential part of every person's wardrobe. It is distinguished by a wide variety of models - from house slippers, summer shoes and practical ballet flats to warm winter boots. Shoes are designed to protect the stupa from mechanical damage, hypothermia, bad weather, etc.

By purchasing this product, we expect to receive a high-quality and durable thing that is distinguished by convenience. According to part 6 of article 5 of the Law "On Protection of Consumer Rights", the warranty period for shoes can be set at the request of the manufacturer or the seller himself.

During this period, the buyer gets the opportunity to exchange a low-quality product, return the money spent or fix the marriage for free.

The warranty period for returning shoes usually ranges from 14 to 30 calendar days, however, for some models, GOST obliges to extend the period up to 2 or 3 months.

The seller or manufacturer has the right to set a longer period. For example, Kari provides a guarantee for the entire range of shoes up to two months inclusive.

Below are the warranty periods for individual categories of footwear:

  • up to two months, according to GOST2063-92 (for sportswear);
  • month, according to GOST 26165-2003 (for children);
  • from two to three months, according to GOST 19116-2005 (for model);
  • up to 35 days, according to GOST 1135-88 and GOST 1135-2005 (for home);
  • from a month to 80 days, according to GOST 26167-2009 (for shoes made of synthetic materials);
  • etc.

The store cannot refuse to return a low-quality product if the warranty established by the manufacturer is still valid for the shoes.

When does the legal warranty period start for shoes?

Shoes are seasonal items, so the warranty period starts from the moment a particular season begins. For example, if you buy a pair of winter boots in autumn, the warranty calculation will start only from November.

It should be understood that the validity of the warranty period is affected by compliance with the operating instructions. For example, summer shoes may not be designed for walking in rainy weather, otherwise the buyer loses the right to a return or free repair due to a violation of the terms of use of the goods.

It should be noted that each subject of the Russian Federation has the right to independently set the time frame for the beginning and end of a particular season, because the territory of our country is located in different climatic zones.

Winter shoes

For the European part of the Russian Federation, for example, for the capital and the Moscow region, the winter season starts on the first of November and ends on the first of March.

For the Altai Territory, this period starts later - from October 15, and ends on March 15. The situation is similar for the Kaliningrad, Volgograd and many other regions.

Winter shoes are intended for use only in the cold season.

spring shoes

The spring season for the European part of the country usually lasts from the first of March to the first of May. In the Trans-Baikal Territory, the calculation of the guarantee for spring shoes begins on April 13, while the season is valid until May 19 inclusive. In the Irkutsk region, this period starts on April 27 and ends on May 29.

Spring shoes have a warm lining and usually have good moisture resistance.

Summer footwear

This season lasts from May 1 to September 1 for the capital, Lipetsk, Magadan, Moscow, Murmansk, Orenburg and some other regions. For example, in the Primorsky Territory, the guarantee for summer shoes, sandals and ballet shoes begins to be calculated from the first of June, and in the Crimea - from May 15 to September 15.

Autumn shoes

The autumn season usually opens from the first of September and ends on November 15, for example, for Moscow, but in the Ivanovo region it lasts only until October 31. Other time frames are provided for other regions of Russia (from September 10 to October 31 in the Krasnoyarsk Territory, from September 1 to November 1 for the Tyumen Region, etc.).

What exactly does the warranty cover?

The warranty period applies to the entire shoe, that is, to its main part and additional components.

The buyer has the right to contact the store or the manufacturer with a claim if he found a defect in the goods. This can be done not only until the end of the warranty, but also after that for two years.

What to do if the heel is broken or the sole is torn off?

Do not rush to go to the workshop in a similar situation. If you have complied with the terms of use of the shoes, and the warranty period has not yet expired, contact the store management and demand that the defect be corrected at the expense of the seller.

The organization has the right to insist on an examination. With its help, the causes of the defect are determined.

If the check proves that the defect is a manufacturing defect, that is, it did not appear through your fault, the store is obliged to repair the shoes for free, replace it with another model or a similar pair, but of the appropriate quality, or even return the money you paid for the purchase.

The procedure for returning shoes during the warranty period

Contact within the warranty period or within a reasonable time after discovering a defect (no later than 2 years from the date of purchase) to the store with. Be sure to include in the text your contact details and full name, the name of the seller and the reason for returning the shoes.

The claim must be supplemented by all the documents you have for the goods (branded box, instructions for use, payment papers, warranty card, etc.).

The absence of the listed documents and packaging is not a basis for refusing to return the shoes. You have the right to confirm the fact of making a purchase using the testimony of witnesses.

If the store refuses to satisfy your legal requirements, file a lawsuit with the court and / or Rospotrebnadzor with a corresponding complaint.
