Instructions for parents: what to do if guardianship authorities take your child away

Antipyretics for children are prescribed by a pediatrician. But there are emergency situations with fever when the child needs to be given medicine immediately. Then the parents take responsibility and use antipyretic drugs. What is allowed to be given to infants? How can you lower the temperature in older children? What medications are the safest?

Theoretically, representatives of guardianship can come to check any family in respect of which a signal has been received from a doctor, from an educational institution or from neighbors, in order to make sure that everything is fine with the child. To avoid most of these “signals”, you should not neglect to comply with legal procedures.

Let the state know that everything is fine with you and your child by following simple rules:

  • do not leave the maternity hospital without an extract (you can always get an extract “on receipt”);
  • do not delay visiting the children's clinic and obtaining a birth certificate;
  • If you are pregnant, contact an antenatal clinic. If a pregnant woman was not observed, gave birth at home, and then is in no hurry to register the child, this may mean either that she adheres to the theory of natural parenthood, or that the woman missed the deadline for an abortion and wants to get rid of the child after its birth;
  • write a refusal to vaccinate - a “silent” refusal may indicate not a conscious position, but banal sloppiness;
  • if you use the services of a paid pediatrician, inform the head of the children's clinic;
  • If your son is involved in a boxing class and bruises appear on his body after classes, report this to the school.

If the guardianship authorities nevertheless come to you, follow the instructions of the portal.

1. Guardianship came to me. Do I have to let them into the house?

Whether or not to allow security guards into the apartment is at your discretion. In accordance with Article 25 of the Constitution of the Russian Federation, housing is inviolable. Against the will of the persons living in the premises, access there is carried out either by a court decision or in cases established by law.

The only statutory case applicable to such situations is the right of police officers (but not guardians) to enter, in accordance with paragraph 3 of Art. 15 of the Police Law, into residential premises if there is sufficient evidence that a crime has been committed or is being committed there (for example, a child screams loudly and hysterically, asks for help). In any case, parents have the right to find out from the police exactly what grounds they have for such assumptions.

If you do not want to let the guardianship authorities in for any reason (guardianship came at an inconvenient time for you, when the child is sleeping; you refused to visit the apartment because those who came refused to take off their shoes), record the reason in writing. For example: “After 22:00 my child sleeps, and I see no reason to violate the established routine of his day. I ask you not to allow the commission’s visits at night in the future” or “I ask the guardianship staff to have spare shoes with them in case of a visit to my apartment for an inspection.” Make a copy of this statement and take it to the guardian. Be sure to make sure that there is a mark of acceptance on it. If they suddenly refuse to accept such an application, it can be sent by mail by registered mail with acknowledgment of receipt with a list of the contents.

2. Guardianship entered the apartment without my consent. What to do?

If the guardianship does not respond to your requests or tries to take the child by force without the appropriate documents, do not hesitate to call 02 with a message that unknown people have broken into your apartment against your will and are taking your child. When the police arrive, they will, of course, be convinced that these are guardianship officers, but insist that you did not invite them to come into the apartment and that they do not have the necessary documents. Insist that police officers help you protect your legal rights.

3. How can I understand that these are not scammers?

There is no need to be embarrassed to check the documents of those who come (ID and passport). It wouldn’t hurt to write down the last name, first name, and patronymic of the people who came to you, so that later you don’t painfully remember who exactly you communicated with. You can also call the guardianship authority back at the phone number listed in the directory and find out whether the people indicated work there and whether they were sent to your address for verification. You may feel a little awkward, but sometimes it's better to feel awkward than to be the victim of a crime.

4. Can I make video or audio recordings during the inspection of the apartment?

Yes, you can record everything that happens on video or a voice recorder. It’s good if the inspection of the apartment is carried out in front of witnesses, for example, you can invite neighbors.
All people in your apartment should be within your field of vision. If someone refuses to take off their shoes under the pretext “I’ll stand in the hallway,” ask him to leave the apartment and lock the door behind him, continuing the “tour” of the apartment for the rest. Attempts to “split up to quickly inspect the apartment” should be immediately stopped: “Please follow me,” “I didn’t invite you into that room,” “I’ll show you everything, but please, in my presence.”

5. Will I be asked to sign any documents?

After the end of the visit, you should draw up a report on the inspection of the residential premises. It must be in two copies. Each copy must be signed by you and the commission members. There should be no empty space, cross out or fill in all spaces before signing. If guardianship representatives refer to the fact that they have 7 days to draw up such a document, please note that you are asking to draw up not an act of inspection of the minor’s living conditions, but rather an inspection act - these are different documents.

6. Guardianship wants my son to be examined by a doctor. Can I travel with my child?

You have the right to travel with your child in the same ambulance and to be present at all medical procedures performed on him. Moreover, according to Art. 32 of the Fundamentals of the Russian Federation legislation on health protection, no medical intervention (including a banal examination) can be carried out without your consent.

7. Can guardianship pick up the child immediately after inspecting the apartment?

It is possible to select, that is, “remove a child from the family,” only on the basis of the relevant act of the executive authority of the constituent entity of the Russian Federation. In the absence of this act, no one has the right to touch your child.
